Do-Not-Call Deadline

Americans who register their phone numbers in the new “National Do-Not-Call Registry” by Sunday night, August 31st, will see a reduction in unwanted sales calls after October 1st. Those who register September 1st, or afterward, will not see a reduction until at least December 1st, or three months after registration. Beginning October 1st, the Federal Trade Commission and the States will begin enforcing the national “do not call” provisions of the new telemarketing sales rules. Violators will be subject to a fine of up to $11,000 per incident. Calls from political organizations, solicitation calls on behalf of charities, and calls to conduct surveys, are not covered by the “National Registry” requirements. In addition, companies with which consumers have an established business relationship may call for up to 18 months after the last purchase, payment or delivery, even if the consumer’s name is on the “National Do Not Call Registry.” Telemarketing organizations will have access to the “National Do Not Call Registry” on September 2nd, one day later than the opening date originally announced. To-date, more than 40 million phone numbers have been registered, with the overwhelming majority processed online.
